Fee agreement addendum concerning the Red Wagon Club

  1. Red Wagon Club Membership: At Sechler Law Firm, we are committed to the success of your planning.  We stand ready to walk alongside you every step of the way to ensure that your estate plan is always up to date.  We are strongly of the opinion that successful estate planning is a process, NOT a one-time fix. Our mission is to provide ongoing support, guidance and advice.  The Red Wagon Club is how we fulfill this mission.   

 

As part of this agreement, you will be automatically enrolled in the Red Wagon Club, which entitles you to all of the following:

 

  • Annual review workshop offered 2x per year to ensure your plan stays current with changing laws, family dynamics, finances and health 

  • Members-Only social events 

  • Specialized workshops offered throughout the year 

  • On-going guidance with the funding of new assets acquired during the year 

  • “Word processing” amendments to your estate planning documents throughout the year at your request (includes simple changes like changing executors) 

  • Law firm-initiated notifications to advise you of general changes in the law that may require changes to your plan 

  • Free meeting with your family upon your disability or death to explain the plan you created and outline the assistance available in maintaining or settling your plan 

  • Discounted fee for estate/trust administration upon your death (10% Discount) 

  • Peace of mind knowing that as life changes, your estate plan is up-to-date  

  • Access to our Weekly Attorney Office Hours for quick answers to your questions

  • The “Don’t Sign It Until We’ve Seen It Pledge” – if someone puts a complicated legal document in front of you and you are confused, just send it over.  We will help you understand what you’re looking at prior to execution.

  • Access to our online Client Video Library  

 

As part of our Red Wagon Club services, we may from time to time recommend legal changes in your documents to take advantage of “general” changes (changes that affect all clients the same) in Trust, Medicaid, Asset Protection, tax law, regulations or judicial decisions. Other changes will reflect ideas that we may learn from experience.  When these changes take place, we notify you of the change in the law or regulations so that you can take advantage of new opportunities. 

The Red Wagon Club program involves a monthly investment beginning the month following the date of execution of your estate planning documents. 

You will be notified of any increases in the Red Wagon Club fee at least thirty (30) days prior to the payment date.  You, or we, may terminate services at any time by providing 30 days’ written notification of the desire to terminate the agreement. Non-payment of the fee within 45 days of your monthly scheduled charge will terminate all services and obligation provided hereunder, including the discount on payment of post-death administration as set forth in the paragraph below.  As part of your participation in the update program, you agree that we may assume that no significant changes in your health, family, or finances have occurred unless you otherwise notify us.  If such changes occur, please notify us immediately and we will be happy to take the necessary steps to address your concerns. 

After Death Settlement Fee Discount:  The final facet of the Red Wagon Club is our settlement fee guarantee. As a participant in our Red Wagon Club, we will agree to represent your helpers with post-death estate or trust administration at a fee equal 10% less than what we would normally charge for such work.  These services of settlement include, but are not limited to: (a) Apply for tax identification numbers; (b) Initial settlement meeting; (c) Explanatory letter to beneficiaries; (d) Transition conference with CPA; (e) Settlement (asset transfer or re-title) instructions to your successor Trustees; (f) Instruction letters to Trustees; (g) Specific bequest letters; (h) Survivor's trust change;  and (i) Preparation of the Inheritance Tax Return. 

It is important to properly fund your estate plan and it is also imperative that you notify us in writing of any new assets (real estate, savings bonds, stocks etc.) or accounts (bank, CD's, passbook, investment, etc.) acquired by you during the year in order to enable us to provide you guidance on proper funding of the new assets. Failure to properly title new assets could result in your estate plan not working as intended. To avoid probate and to ensure the settlement fee discount, you must notify us of any new accounts or assets and fund them to your trust(s) in accordance with our instructions. Remember, as participants in our Red Wagon Club there is no cost to receive our instruction on funding new assets.  Failure to notify us will relieve us of our post- death fee discount as to those assets or items we have not been notified of or you have failed to re-title. 

  

Investment and Billing

The investment for the Red Wagon Club is $150.00 per month, which will begin the month after you execute your estate planning documents.  You may cancel this agreement at any time by providing 30 days’ written notice.  You agree to provide Sechler Law Firm with a credit card to set up an automatic billing plan, or alternatively you may enroll in ACH billing.  In signing up for the club, you authorize SLF to keep your credit card information on file in our secure processing system. We agree to take all reasonable steps to keep your credit card information secure.
